TERMS AND CONDITIONS OF USE OF TOMANJI APP

1. Introduction

Welcome to the Tomanji App (hereinafter referred to as the “Application”), an entertainment platform that offers various game modes. By accessing or using our Application, you agree to be bound by these Terms and Conditions (hereinafter referred to as the “Terms”), as well as our Privacy Policy.

2. Acceptance of the Terms

By downloading, installing or using the Application, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Application.

3. Modifications to the Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on the Application. It is your responsibility to periodically review the Terms for updates.

4. Use of the Application

  • Free Access: The Application offers a free mode that can be used without registration. After playing, the Application will be locked for a period of 20 minutes before you can access the game again.
  • Minimum Age: You must be of legal age under the laws of your country of residence to use the Application. By using the Application, you represent and warrant that you meet this age requirement.

5. In-App Purchases and Subscription Model

5.1. Previous Integrated Purchases

Previously, the App offered in-app purchases that allowed users to purchase:

  • Pro Version: Full access to all features for a one-time fee of $15.99.
  • Single Player Modes: Each available for a one-time cost of $3.99.

For these purchases, a service duration was not specified at the time of the transaction.

5.2. Updating the Purchase Conditions

In order to improve our services and offer a more dynamic experience, we have updated our in-app purchasing policies:

  • Purchases made in 2023 or before (including 2023):

    • As of 08-15-2024, purchases of the Pro Version or individual modes made in 2023 or before will no longer be active.
    • Users who wish to continue enjoying this content must subscribe to the new subscription system.

  • Purchases made during 2024:

    • Users who have purchased the Pro Version or any individual mode during 2024 will maintain access to their purchases until December 31, 2024.
    • Starting January 1, 2025, you will need to subscribe to the new subscription system to continue accessing this content.

5.3. New Subscription System

  • Service Description: The new subscription model will offer unlimited access to all game modes and premium features of the App.
  • Cost and Duration: Details about subscription plans, including pricing and duration, will be available in the in-App purchases section.
  • Automatic Renewal: Subscriptions will automatically renew at the end of each period unless cancelled at least 24 hours before the end of the current period.
  • Cancellation: You can manage or cancel your subscription at any time through your account settings in the relevant app store.

6. Refund Policy

  • Previous Purchases: Refunds will not be provided for Pro Version or individual mode purchases made in 2023 or earlier.
  • Subscriptions: Subscription fees are non-refundable, except where required by applicable law.

7. Intellectual Property

All content, features and functionality of the Application (including but not limited to information, software, text, displays, images and design) are the property of Pckz LLC and are protected by copyright and other intellectual property laws.

8. User Conduct

By using the Application, you agree to:

  • Do not use the Application for any illegal or unauthorized purpose.
  • Do not interfere with the normal operation of the Application.
  • Do not attempt to gain unauthorized access to our systems or networks.

9. Limitation of Liability

To the maximum extent permitted by law, Pckz LLC shall not be liable for any indirect, incidental, special or consequential damages that result from the use of, or inability to use, the Application.

10. Compensation

You agree to indemnify and hold Pckz LLC, its affiliates and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Application or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Application at any time, without notice, for any reason, including but not limited to breach of these Terms.

12. Divisibility

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

13. Complete Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Pckz LLC with respect to the Application and supersede all prior or contemporaneous agreements.
