This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and Pckz, application developers Taboo x Tomanji, Mime x Tomanji, Who I Am x Tomanji, and Bomb x Tomanji (collectively, the “Applications”). By downloading, installing, accessing or using any of these Applications, you agree to the terms and conditions set forth in this EULA. If you do not agree to these terms, you must not download or use the Applications.

1. License

Pckz grants you a limited, non-exclusive, non-transferable, revocable license to use each of the Applications on supported devices in accordance with the terms and conditions of this EULA. This license is granted solely for your personal, non-commercial use.

2. Intellectual Property

All rights, title and interest in and to the Applications, including but not limited to content, graphics, user interfaces, text, software and code, belong to Pckz. This license does not grant you any rights to the intellectual property of the Applications, except for the limited right to use them in accordance with these terms.

3. Restrictions

The User shall not, directly or indirectly:

• Modify, decompile, disassemble, reverse engineer, attempt to derive the source code of, or create derivative works of the Applications.
• Use the Applications for illegal or immoral purposes or for purposes that infringe the rights of third parties.
• Distribute, rent, sublicense, sell, resell or commercially exploit any part of the Applications.

4. Updates

Pckz may provide updates, upgrades or modifications to the Applications. Such updates may be installed automatically without prior notice. User agrees that such updates form part of the Applications and are subject to the terms of this EULA.

5. Privacy and Data Collection

Use of the Applications involves the collection and processing of personal data in accordance with Pckz's privacy policy. This policy describes how your personal data is collected, used, shared and protected.

6. Duration and Termination

This EULA is effective from the moment you download or use any of the Applications and will remain in effect until terminated. Pckz reserves the right to terminate or suspend your access to the Applications at any time and for any reason, including, but not limited to, your breach of the terms of this EULA. Upon termination of this agreement, you must cease all use of the Applications and delete any copies of them.

7. Limitation of Liability

The Applications are provided on an “as is” and “as available” basis without warranties of any kind. Pckz does not warrant that the Applications will be error-free, uninterrupted or defect-free. In no event shall Pckz be liable for any direct, indirect, incidental, special or consequential damages arising out of the use or inability to use the Applications.

8. Modifications to the Terms

Pckz reserves the right to modify this EULA at any time. Any modifications will be effective immediately upon posting on the Applications. Your continued use of the Applications after any changes are posted constitutes your acceptance of those changes.

9. Applicable Law

This EULA shall be governed by and construed in accordance with the laws of Chile, without regard to its conflict of law provisions. Any dispute arising in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Chile.

10. Full Agreement

This EULA constitutes the entire agreement between the User and Pckz with respect to the use of the Applications and supersedes any prior agreements relating to the subject matter hereof. Any waiver of these terms must be in writing and signed by both parties.
